For their TBB solution, why cant they recognize that 
the searches are coming through Tor and allow them to proceed?

Their "more permanent solution" bypasses the Tor network entirely,
with a misleading claim their system is somehow just as safe or private.
It won't work for those using Tor in order to get around firewalls or censorship.
Secondly, we are supposed to trust their "3rd party certification" which
only looked at the company's policy and did not inspect the actual machines.
Furthermore such policies offer no guarantee against government orders
to track users or against intercepts capturing all data coming into their systems.
